RETAIL GIFT AID AGENCY AGREEMENT TERMS AND CONDITIONS

For claiming Gift Aid on the sale of donated goods

 

   1. After signing the Gift Aid declaration and presenting it to a Barnardo’s shop, you will be given a unique Donor ID number, which will be used to identify your donated goods so that we can track the money generated from the sale of your goods.

2.  Barnardo’s Trading Limited ('BTL') will be free to decide whether all or any of your goods are suitable for sale and will seek to sell your goods on your behalf in whatever manner it decides and at the price that BTL considers appropriate. If BTL considers that allow any of your goods are unsuitable for sale, have not sold within a reasonable period or BTL in its sole discretion reserves the right to take ownership of these goods and sell, recycle or otherwise dispose of them as it sees fit and is not under any obligation to notify you of any proceeds accruing or retained from such sale(s).

 

3.  A commission of 1.5% (plus VAT) will be charged by BTL on the sale proceeds realised from selling your goods to cover the costs of administering the Gift Aid scheme. BTL is a wholly owned subsidiary of Barnardo’s and pays its taxable profits to Barnardo’s (to the maximum amount permissible). From time-to-time BTL will review its commission rate but will only be required to formally notify you of any change where there is an increase in that rate to above 5% (plus VAT). The current rate will always be available on the web.

 

4.   Barnardo’s will only seek to claim Gift Aid tax relief on the net proceeds of your goods after the sales commission received by BTL.

5.  You agree that BTL is instructed, as your agent, to donate the net proceeds of sale of your goods to Barnardo’s and that it is not necessary to contact you to confirm the donations, provided that the total value of the  net proceeds of sale of your goods in a tax year has not exceeded £1,000 (or such higher amount as is specified by HMRC from time to time). Under this agreement you are deemed to have consented to funds up to £1,000 in a tax year being donated to Barnardo’s. Once a sale is made that brings the total value of the net proceeds of sale of your goods to more than £1,000 in a tax year (or such higher amount as is specified by HMRC from time to time), we shall write to you to confirm your consent to those funds over and above the initial threshold of £1,000. We will notify you annually of the total value of sales achieved in a tax year at the start of the next tax year. This statement provides information you may find useful in settling your tax position and for completing your Self-Assessment tax return if you are asked to complete one. The statement does not permit the request for a refund of all or part of the Net Proceeds. If you pay Income Tax at the higher or additional rate and want to receive the additional tax relief due to you, you must include all your Gift Aid donations on your Self-Assessment tax return or ask HMRC to adjust your tax code. If less than £20 has been raised from the sale of all your goods during a 36-month period, you hereby agree that BTL may treat the goods as having been donated to Barnardo’s. In this instance BTL may choose not to contact you regarding the Net Proceeds.

 

6.  If we write to you to notify you that the net proceeds from the sale of your goods in a tax year exceeds £1,000, you will have 21 calendar days from the date that the we write to you (that is, the date of the  email or letter that we send to you) to  respond to us if you  choose to retain part or all of the net proceeds that exceed the £1,000 threshold. In these circumstances, we will endeavour to make payment to you within 45 days. Your response must be posted to the postal address from which you received the notification from us. If you request all or part of the net proceeds after the 21-day period has expired, we may, in exceptional circumstance, and at our discretion, make a payment to you. If you request all or part of the net proceeds, this agreement shall terminate immediately, and you shall no longer be eligible to participate in this scheme and sell goods through BTL as your agent. You waive the right to claim interest that may have accrued on any cash you decide to reclaim from the sale of your goods. We may send you the Net Proceeds notification by e-mail if you have provided your e­ mail address on the Gift Aid Declaration Form or otherwise by letter to the home address provided.

 

  7.  If we do not receive a reply from you within 21 days, we will assume your consent that the net proceeds are to be donated to Barnardo’s using Gift Aid.

8.  You may request an annual statement of the proceeds from the sale of your donated goods. irrespective of the value of the sales, by

sending an email to Retailgiftaid@barnardos.org.uk . If you request this statement, it will be sent to you at the start of the new tax year and contain sales proceeds relating to the previous tax year.

 

9. We need to advise you that:

a) Subject to you being a UK tax payer , Barnardo’s will reclaim  25p of tax  on every £1 of  Net  Proceeds generated on cash from the  sale of your goods (whilst the basic rate of income tax remains at 20%). The amount of Gift Aid claimed could be subject to change in legislation. To qualify for Gift Aid you must pay more Income Tax and/or Capital Gains Tax than the amount of Gift  Aid  claimed on  all your donations in that tax year and it is your responsibility to pay any difference. Please notify the charity if you want to cancel your declaration, change your name or home address or no longer pay sufficient tax on your income. Please advise us by sending an email to Retailgiftaid@barnardos.org.uk

b) Although unlikely, you may be liable to capital gains tax if one of your goods (for example jewellery, paintings, or antiques) is disposed of for more than £6,000 and your total capital gains for the year exceed the annual tax-free allowance. Any such liability arising remains your responsibility. If you sell significant quantities of goods in this way, you must also consider your own position in terms of income tax on trading activities.

c) In the unlikely event of a purchaser returning any of your goods to a Barnardo’s shop for refund or exchange due to a fault or a change of mind, BTL will assume financial responsibility for the refund or exchange as appropriate. The purchaser will have no recourse to you on either the condition of your goods or for any monies that are received on your behalf.

 

   10.  We may write to you in accordance with this agreement by email if you have provided your email address on the Gift Aid declaration and otherwise by letter to your home address as set out on              the declaration, unless you have notified us of any change to your  email address or home address.

11.  This agency agreement may be terminated by you or BTL at any time.
